BRAINFX® WEBSITE PRIVACY POLICY

BRAINFX INC. ("BRAINFX") is committed to protecting your Personal Information (defined below) as explained in this privacy policy (the "Website Privacy Policy").

"Personal Information" is any information that can identify you and includes, but shall not be limited to, your name, mailing address, email address and image that you enter into the website interface when creating your account. If you are a client, Personal Information will also include the information you enter into the BrainFX website interface as part of your self-assessment, as well as the performance results of the BRAINFX 360 Assessment that is sent to your myBrainFx profile. If you are a healthcare professional, Personal Information will also include your member ID number issued by your governing professional college and the results from your BrainFx 360 Certification course that you are required to complete to become a Certified BrainFx Administrator.

Use and Disclosure of Personal Information

Personal Information about clients is used and disclosed to the healthcare professional chosen by the client to conduct the BrainFX 360 assessment in order to book appointments, confirm client identity, perform the BRAINFX 360 assessment and provide you with results of your assessment. Personal Information about healthcare professionals is used to confirm the healthcare professional's status as a practising healthcare professional, provide clients with contact information to book appointments and to confirm successful completion of training on the BrainFX 360 assessment tool.

BRAINFX may share your Personal Information with its partners or service providers for the purpose of providing you with access to the BRAINFX website and services. In each case, BRAINFX shall require such partners and service providers to comply with this Website Privacy Policy.

BRAINFX may use Personal Information along with the information of all or some of the other users of the Website to generate aggregated data that does not contain Personal Information (the "Aggregated Data"). BRAINFX may use the Aggregated Data or share it with third parties for research purposes, for example, to improve the functionality of the Website. Any third party who receives such Aggregated Data must agree that they will not attempt to make the information personally identifiable, such as by combining it with other databases.

In the event of a sale, amalgamation, re-organization, transfer or financing of parts or some or all of BRAINFX’s business, users’ Personal Information may be disclosed to an acquiring organization, either as part of due diligence or on completion of the transaction. If Personal Information is disclosed to an unaffiliated third party in this context, BRAINFX will require that the third party agree to protect users’ Personal Information in accordance with this Website Privacy Policy.

Your Personal Information will not be otherwise used or disclosed for any purpose without your consent, except as required or permitted by law.

Protection of Information

BRAINFX has implemented commercially reasonable security safeguards to protect Personal Information against loss or theft, as well as unauthorized access, disclosure, copying, use or modification. Methods of protection include: physical measures (e.g., locked filing cabinets and restricted access to offices); organizational measures (e.g., security clearances and limiting access on a "need-to-know" basis); and technological measures (e.g., the use of passwords and encryption). Unfortunately, no data transmission over the Internet or by electronic mail can be guaranteed to be 100% secured and, as a result, BRAINFX cannot ensure or warrant the security of any information transmitted to us electronically.

Your Rights

You may withdraw your consent to BRAINFX’s collection, use and disclosure of your Personal Information at any time, on reasonable notice, subject to legal or contractual restrictions. Should you choose, to withdraw your consent, please immediately contact BRAINFX’s Chief Privacy Compliance Officer in writing at the address listed below. Your Personal Information will be retained only as long as necessary for these purposes or as required by law.

At any time, you may challenge the accuracy and completeness of your Personal Information and have it amended as appropriate. In any such case, BRAINFX may request that you provide identifying information sufficient for it to permit such amendment. Any such identifying information shall be used only for this purpose. However, be aware that the right to access personal information is not absolute and access may be denied for various reasons as permitted by law.
